Terms and conditions

These terms apply when you order from Mike Bakes London. Please read them before you check out. You are asked to confirm you accept them as part of placing an order.
Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015 or any other law that cannot be set aside by agreement.
1. Who you are dealing with
Mike Bakes London, a bakery operating in Belgravia, London SW1. You can reach us at info@mikebakes.uk or +44 7922 122149.
2. Placing an order
- Every item is baked to order. Orders need at least the notice period shown on each product page, which is normally 48 hours and can be longer for larger cakes.
- The minimum order value is £50. Delivery and tips do not count towards it.
- Your order is an offer to buy. A contract is formed when we confirm your payment has succeeded and send you an order confirmation by email.
- If we cannot fulfil an order after payment, for example because an ingredient is unavailable or a date becomes impossible, we will contact you and refund you in full.
- Prices are in pounds sterling and include VAT where it applies. Most cakes and bread are zero rated for VAT in the UK.
3. Allergens and food safety
Please read this section carefully if you or anyone eating the food has a food allergy or intolerance.
- Each product page lists the allergens present from the fourteen that must be declared under the Food Information Regulations 2014. We also list ingredients where we can. If anything is unclear, ask us before you order.
- Everything is made by hand in a single kitchen that handles cereals containing gluten, eggs, milk, nuts, peanuts, soya, sesame and sulphites. Because of that we cannot guarantee that any product is free from any allergen, however carefully it is made. We do not have a separate allergen free production area.
- If you have a severe allergy, please tell us at checkout and contact us directly before ordering so we can tell you honestly whether we can serve you safely. Sometimes the right answer is that we cannot.
- The allergy box at checkout is passed straight to the kitchen and appears on your order. Please use it. We can only take account of what we are told.
- Where you have told us about an allergy, we will tell you plainly whether we can meet it. If we accept your order on that basis, we are responsible for handling it with proper care, subject to the cross contamination position above.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Any clause elsewhere that appeared to do so would have no effect.
4. Delivery
- We deliver across London and Surrey. The fee is calculated from your postcode at checkout. If your postcode is outside the areas we cover, checkout will tell you.
- You choose a date and a time window. We aim to arrive within that window but cannot guarantee an exact time, as traffic and the order of the round vary.
- Someone needs to be there to receive the order. If nobody is available and we cannot leave it safely, we may have to return it, and we cannot usually refund fresh food in that situation. Please give us a phone number and any access instructions.
- Risk in the goods passes to you on delivery.
5. Changes and cancellations
Because everything is freshly baked to order and made to your specification, the fourteen day right to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. Those Regulations specifically exclude goods that are liable to deteriorate rapidly and goods made to a consumer's specification. This does not affect your rights if the goods are faulty.
- To change or cancel an order, contact us as soon as possible. If we have not started baking or bought ingredients specifically for it, we will normally refund you in full.
- Once baking has begun we may not be able to refund, because the food cannot be sold to anyone else.
- Personalised items, such as a piped message, cannot be cancelled once made.
6. If something is wrong
Under the Consumer Rights Act 2015 the food must be of satisfactory quality, fit for purpose and as described. If it is not, tell us within 24 hours of delivery, with a photo if you can, and we will put it right with a repair, replacement or refund as appropriate.

7. Payment
Payments are handled by a secure payment provider. We never see or store your full card details. Your card is charged at the point you complete checkout.
8. Photographs and descriptions
Our photographs show the style of what we make. Because everything is finished by hand, the item you receive will vary slightly. Decoration, colour and fruit change with what is good and available.
9. Your information
How we handle your personal information, including any allergy information you give us, is set out in our privacy notice.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
